The Lawyer's role is to ensure that you have been delivered clear title to the property as well as to make certain that the Deed and Mortgage have been properly registered in your name.

You need a lawyer to protect your legal interests by confirming that the property you have purchased does not have any statutory liens, charges or work orders registered against the property. The Lawyer will perform all necessary searches to reveal any discrepancies.

The Lawyer will also be responsible for preparation of all legal documents required to complete all purchase and sale transactions, including the preparation of all deeds and mortgages associated with each transaction.

The Lawyer is also be responsible for obtaining all the funds necessary to complete the transaction including mortgage lender money and your balance of the down payment which will be held in trust pending completion of the transaction on closing.

If you are selling, the Lawyer will be responsible for paying out all existing mortgages and liens that are registered on title at the time of closing pursuant to a discharge statement, which is obtained from your mortgage lender. The Lawyer will also ensure that the mortgage is properly discharged from title.
